Professionnal Immigration

Professionnal Immigration

If you are planning to work in France with a contract of employment, your employer is generally responsible for carrying out the formalities with the ANAEM (www.anaem.fr). The ANAEM will ask the visa section to proceed to the formalities of your immigration. At this step, the visa section will inform you that you can book an appointment to submit your file.

However, depending on your status and on the kind of activity you are planning to exercise in France some easier process can be offered. They are detailed hereunder.

Also, if you want to invest in France, or create a project, a company or business and you wonder about the legal, tax and social framework, you will find clear and accurate information on the website of the French Agency for international investment :

1. The New « Skills and Talents » permit

You have a project. The “Skills and Talents” permit, valid for an initial period of three years and renewable thereafter, allows you to carry out any professional activity of your choice in connection with your project.

To get more information about the frame of competences considered, you can click here

Your project is intended to allow you to participate in the economic development of France and/or your country of origin.

You must submit your application to the concerned section of the French Embassy, in connection with the purpose of your project. The Ambassador will decide whether or not you are eligible for this permit.

The issued visa will allow you to obtain your “Skills and Talents” permit when you arrive in France. It will allow you to stay and work in France.

This permit will also enable your family members accompany you in France. They will be issued with a “Private and Family Life” permit allowing them to work.

2. The "Intra-company transfer" permit

This other new permit aims at easing the mobility of workers within international groups or companies. It allows a foreign worker to be sent to France by his company to work in an enterprise belonging to the same company or the same group.

To benefit from the "Intra-company transfer" permit, the worker has to fulfil two conditions :

- he has to justify a minimum period of 3 months of service with the foreign employer, prior to being sent to France.

- he must earn a minimum wage of 1900 euros (for top level executives, the minimum earning will be 5000 euros).

The "Intra-company transfer" permit gives the same sorts of advantages as the "Skills and Talent" one :

- this permit will be valid for 3 years ( an exception to the usual annual working permit rule). This period is renewable thereafter.

- the employer in France does not need to apply for the prior endorsement of the work contract by the French Ministry of Labour.

- the holder’s family members are not subject to family grouping conditions or procedure. After a period of 6 consecutive months residence in France of the holder, his family will be issued with a "Private and Family" permit allowing them to work.

This permit is now well known among the international business community and our consulates issue it more and more.

3. The “employee on Assignment” card for senior managers or high-level executives

You are employed by a French company that is part of an international group. If you have a very responsible role or if receive a gross monthly salary that is greater than or equal to 5,000 euros, you will be issued with a residence permit valid for a period of three years.

Your family can accompany you with a “visitor” residence permit which will allow your spouse to work.

WARNING : For “employee on Assignment” and “employee on Assignment card for senior managers or High-level executives” permits : your employer, based in France and wishing to recruit you, is responsible for carrying out the formalities with the ANAEM (Agence Nationale de l’Accueil des Etrangers et des Migrations), but the process is accelerated.

4. « Scientific » permit

If you have a master’s degree or equivalent, you can come to France to carry out research or teaching activities.

You must prove your status as a researcher and the planned duration of your research work, and present a “convention d’accueil” (hosting agreement) from an accredited French research institution or teaching facility.

The permit will be issued to you by the Prefecture on presentation of the required long-stay visa and your hosting agreement, endorsed by the French Consulate in your country of origin.

In that case, your employer based in France, and wishing to recruit you, is responsible for carrying out the formalities with ANAEM (Agence Nationale de l’Accueil des Etrangers et des Migrations).

You can cumulate several contracts in succession, provided that commit to spending no more than six months per year in France and to maintain your usual residence outside France.

This permit does not allow your family to join you.
